Cimetrix® software contains or uses third-party software or other materials protected by copyright laws, international copyright treaties, and other intellectual property laws and treaties. The following terms apply to such third-party software and other materials, notwithstanding any other provision of the Cimetrix License Agreement:
Cimetrix Software
Cimetrix CIMConnect™, CIM300™, CIMPortal Plus™, ECCE Plus™, EDAConnect™, CIMStore™, SECSConnnect™,TestConnect™, Cimetrix EquipmentTest™, and Cimetrix HostConnect™ Software contains or uses WPF NotifyIcon software, which third-party software is governed by The Code Project Open License (COPL) version 1.2. A copy of the COPL can be found at http://www.codeproject.com/info/cpol10.aspx. Your installation, copying, execution, or other use of the CIMConnect, CIM300, CIMPortal Plus, ECCE Plus, EDAConnect, CIMStore SECSConnnect, TestConnect, Cimetrix EquipmentTest™, or Cimetrix HostConnect, Cimetrix Software constitutes your agreement to be bound by all of the terms and conditions of the COPL with respect to the WPF NotifyIcon software. If you are unwilling to be bound by the COPL with respect to the WPF NotifyIcon software, you may not install, copy, execute, or otherwise use the CIMConnect, CIM300, SECSConnnect, or TestConnect Cimetrix EquipmentTest™, or Cimetrix HostConnect Cimetrix Software.
Cimetrix EDA Software
Cimetrix CIMPortal and CIMPortal Plus Software contains or uses MwControls software developed by Mikael Wiberg. THE MWCONTROLS SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE MWCONTROLS SOFTWARE.
Cimetrix CIMPortal Plus Software also contains the Castle Core and Castle Windsor software, which are governed by the Apache 2.0 license, a copy of which is included in the Release Notes and is available at http://www.apache.org/licenses/LICENSE-2.0.
Cimetrix ECCE Plus Software contains or uses DevAge SourceGrid software. THE DEVAGE SOURCEGRID SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE DEVAGE SOURCEGRID SOFTWARE.
Cimetrix CIMStore Software is distributed with MySQL C Connector software and, for versions of CimPortal Plus Software prior to version 2.4.0, Oracle Connector software, which Cimetrix distributes under a license from Oracle Corporation (“Oracle”). You may only implement or use the MySQL C Connector or the Oracle Connector software, however, pursuant to a valid Oracle license that you or your equipment provider obtains. You may obtain an Oracle license from Cimetrix, which is an authorized reseller, for use solely with the Cimetrix CIMStore Software, or you may Contact Oracle or your equipment provider for details or licenses that are not limited to use with the Cimetrix CIMStore Software.
Cimetrix Equipment Control Software
Cimetrix CIMControlFramework™ Software contains or uses the Rhino Mocks software. THE RHINO MOCKS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. THE CONTRIBUTORS TO THE WPF EFFECTS LIBRARY GIVE NO EXPRESS WARRANTIES, GUARANTEES OR CONDITIONS. YOU MAY HAVE ADDITIONAL CONSUMER RIGHTS WITH RESPECT TO THE WPF EFFECTS LIBRARY UNDER YOUR LOCAL LAWS WHICH THIS LICENSE CANNOT CHANGE.
